The St. Francis [Catholic] Healthcare System in Hawaii, sponsored by The Sisters of the Third Franciscan Order of Syracuse, New York, “committed to creating healthy communities in the Spirit of Christ’s Healing Ministry,” now seems to be committed to defrauding federal taxpayers under Medicare & Medicaid. TMA International Trusts (TMAIT), the “Relator” or “Private Attorney General” in Hawaii’s largest Whistleblower case in history has caught St. Francis Healthcare System in Hawaii violating federal felony statutes associated with “Patient Rights” and their Social Security Numbers (SSNs) in conjunction with Medicaid & Medicare.

Always a leader in establishing healthcare services for the people of Hawaii, the St. Francis Healthcare System of Hawaii has grown from a 50-bed hospital to a five-entity corporation with the help of Federal Funding Fraud. St. Francis is dedicated to providing healthcare and promoting healthy communities throughout the state. Their two medical centers are supplemented by health clinics, satellite facilities on four neighboring islands and hospice and home care services. The St. Francis Healthcare System became operational in January 1996. The System is comprised of: St. Francis Medical Center; St. Francis Medical Center-West; St. Francis Community Health Services; St. Francis Healthcare Foundation; St. Francis Healthcare Enterprises, Inc.; and Residential Care Community. Unfortunately they have been participating in massive federal funding fraud under Medicaid & Medicare, and after being notified by TMAIT they then went into a systematic cover-up, which is ridiculous because TMAIT has the physical evidence to support the allegations. In fact, TMAIT contacted The Sisters of the Third Franciscan Order of Syracuse, New York, and informed them of Hawaii’s illegal activities only to watch Hawaii attempt to hide from their legal indiscretions.

St. Francis Healthcare System Hawaii has been violating Medicaid & Medicare Conditions of Participation (CoP) regarding “Patient Rights” and Patient’s SSNs. In addition, they have been aiding & abetting the State in massive Medicaid / Medicare Fraud that goes back years. The State is hiding from TMAIT, but that is pretty much irrelevant as TMAIT has federal legal standing to bring State Officials, and any other party affiliated with the federal funding fraud, to U.S. District Court in Washington, D.C. as TMAIT has FCA enforcement authority and the only private party who can file the “Qui Tam” lawsuit on this issue by being the “original source of information.”

The Sisters will now have to answer to their participation in a Hawaii Criminal Enterprise that includes the State, which has bilked federal taxpayers out of Billions of Dollars. Not to single out just the Sisters, all of Hawaii’s other Hospitals who participate in Medicaid & Medicare are in the same situation as the Sisters. The joint & several, statutory liability under the Federal False Claims Act (FCA) and RICO is somewhere between $60-80 Billion. Unfortunately for the Hospitals the State, who is the “King Pin” of the Racketeering Enterprise, has immunity under RICO and the FCA, the Hospitals do not. Hawaii’s future Healthcare System is in for some serious changes, including possible elimination of certain Hospitals through litigation resulting in bankruptcy. Hawaii’s Governor and Attorney General are ignoring the problem.
